You shall defend, indemnify, and hold harmless Mensbest and all of its officers, employees, owners, contractors, and agents (“Mensbest Entities”) from and against all third-party claims, suits, demands, losses, judgments, damages, costs, liabilities and settlements (including the costs and fees of attorneys) (collectively, “Liabilities”), arising out of or relating to, directly or indirectly, your acts or omissions when, or as a result of, Engaging. If you receive notice of any potential Liabilities, you must notify Mensbest at once, using the contact information provided on the Mensbest site. If Mensbest participates in defense against Liabilities, you hereby agree to fully assist Mensbest.

MENSBEST PROVIDES NO WARRANTY THAT ITS WEBSITE, SERVICES (INCLUDING, BUT NOT LIMITED TO, ITS PRODUCT REVIEWS AND RANKINGS, AND FUNCTIONALITY OF THE SITE), ANY GOODS MENTIONED ON THE SITE, AND ANY WEBSITES TO WHICH MENSBEST LINKS, ARE FREE OF DEFECTS, ERRORS, OR OMISSIONS. MENSBEST DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUALITY, SUBJECT MATTER, AVAILABILITY, AND TITLE. MENSBEST SHALL HAVE NO LIABILITY IN THAT REGARD. ITS SERVICES ARE PROVIDED ON “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS” BASES.

YOU ENGAGE AT YOUR OWN RISK. IF YOU HAVE OBJECTIONS, DIFFICULTIES, OR DISAGREEMENTS WITH MENSBEST, ITS CONTENT, AND/OR ITS FUNCTIONALITY, YOUR SOLE RECOURSE IS TO CUSTOMER SERVICE, MEDIATION, BINDING ARBITRATION, OR THE DISCONTINUANCE OF YOUR ENGAGING. MENSBEST SHALL NOT BE LIABLE FOR CONSEQUENTIAL, PUNITIVE, DIRECT, INDIRECT, EXEMPLARY, INCIDENTAL, OR SPECIAL DAMAGES WITH RESPECT TO YOUR ENGAGING, NEITHER TO YOU NOR TO ANYONE ELSE. MOREOVER, ANY CLAIMS YOU HAVE AGAINST MENSBEST ENTITIES SHALL NOT ENTITLE YOU TO AN INJUNCTION OR OTHER EQUITABLE RELIEF, AS THEY ARE NOT OF AN IRREPARABLE NATURE.

The Terms (which include the footnote disclaimer, Disclosure Statement, Privacy Policy, Arbitration Agreement, and statement of Review Process), constitute the entirety of the agreement between you and Mensbest. Any oral or written communications prior to your Engaging are hereby superseded and are of no force or effect.

If there are inconsistencies between, on the one hand, any provision of the footnote disclaimer, Disclosure Statement, Privacy Policy, Arbitration Agreement, statement of Review Process, or this Terms and Conditions document, and, on the other hand, the Arbitration Agreement, the Arbitration Agreement shall govern.

If any part of the Terms are adjudicated or otherwise determined by a legal or arbitral authority to be non-enforceable, all other portions shall remain in full force and effect.
